Terms of use for the free area comparison report (Nutzungsbedingungen)

This is a translation for your convenience. The German version is legally binding.

1. Provider and service

The provider is Felix van Musschenbroek, trading as “PMC Juridisch Advies”, Postbus 130, 1250 AC Laren, Netherlands. You can reach us at info@regenrechner.de.

Regenrechner is aimed at consumers who want to understand the details of the rainwater fee (Niederschlagswassergebühr) for a private residential property.

Towns currently supported: Bremen and Reinbek. For other towns and municipalities, we will tell you by email whether we can handle your request.

2. What the report contains

We measure the visible roof and paved areas of your property on official, publicly available aerial photos and compare them with your details. If you upload a notice, we include the areas stated in it in the comparison. The report states the difference in square metres.

The report also contains example calculations. Each example calculation is based on an expressly stated assumption that you choose, for example that a certain area does not drain into the public sewer. For each assumption, the report shows the calculated difference in euros using your town’s published fee rate and published factors. We list these rates and factors as a general table with sources.

The report states the image source, image date, scale, measuring method and measurement uncertainty. Areas are measured in plan view; the real area of a sloping roof is larger. An aerial photo measurement does not replace a survey on site. In particular, underground pipes, overflows and the actual drainage cannot be reliably determined from an aerial photo alone.

The report is prepared by Felix van Musschenbroek with the help of an AI assistant and checked by him before it is sent.

3. Limits of the service

Felix van Musschenbroek is not a lawyer. The report is not legal advice, does not replace individual legal advice and is not an official notice.

We do not decide which fee category or factor legally applies to an area, a cistern or a roof on your property. We do not tell you which values to enter on a form or portal of your town or of hanseWasser. We do not assess whether a notice is correct or lawful.

We do not write objections (Widerspruch) and do not represent you or correspond with your town or hanseWasser for you. Deadlines, legal remedies, refunds and the validity of a notice are not part of the order.

You decide yourself what you tell the responsible authority and you submit forms or messages yourself. Please check factual details, in particular on drainage, before you send them.

No particular fee reduction, refund or acceptance by the responsible authority is promised. The fee set is determined by the notice of the responsible authority. Your statutory rights against a notice are not affected.

For questions on deadlines, objections, refunds or the legal classification of your areas, please contact a lawyer or an authorised advice service, such as Haus & Grund (the German homeowners’ association) within its advice offering.

4. Free quota and conclusion of the contract

The first 20 reports are free. There is no handling fee, no success fee and no obligation to buy further services.

Places are allocated in the order in which complete requests for the supported towns arrive. What counts is the receipt of the details needed for the report. Uploading a notice is not required.

By sending the form, you offer to conclude a free order with us under these terms of use. You receive a confirmation of receipt by email. A contract is concluded when we confirm by email that we accept the free order. The confirmation of receipt alone is not an acceptance.

If the free quota is used up or we cannot handle the request, we will tell you. Your request is never automatically turned into a paid order.

5. Your details and delivery

Please give the details needed for the work to the best of your knowledge. Uploading a notice or photo is optional. Please remove personal details we do not need from uploaded documents.

For accepted orders, we deliver the report by email within 48 hours of receiving all the details needed. If details are missing or contradictory, we will ask; the period starts once all the details needed are complete.

If a delay becomes apparent, we will inform you without delay. Your statutory rights in the event of a breach of duty remain.

6. Ending the free order

You can end a free order that has not yet been fully carried out at any time by sending a message to info@regenrechner.de. We do not charge any costs or expenses for this. Statutory rights of withdrawal and other rights to end the contract are not affected.

7. Liability

We are liable without limitation for intent and gross negligence and for damage resulting from culpable injury to life, body or health.

In the case of simple negligence, we are liable for damage resulting from the breach of an essential contractual duty. An essential duty is one whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely. In this case, liability is limited to the damage that was foreseeable and typical for the contract when it was concluded.

Otherwise, liability for damage caused by simple negligence is excluded. Mandatory statutory liability, in particular under the German Product Liability Act and the GDPR, and liability under expressly given guarantees are not affected.

These rules also apply in favour of the people we use to fulfil our contractual duties.

8. Data protection and contract information

Information on the processing of personal data can be found in our privacy policy.

The language of the contract is German. Before sending, you can check and correct your details in the form fields. You can save or print these terms.

When we accept your order, we send you the agreed terms and the content of your order by email. We do not keep the contract text available for you to retrieve separately; please keep this email.

9. Applicable law

German law applies. Mandatory consumer protection rules of the country where you usually live continue to apply where they give you more protection. The statutory jurisdiction of the courts is not affected.
